ERA Media Release - Mr Erwan Charpy & Mr Mujeeb Rahman

The ERA Stewards opened two separate inquiries on Tuesday 10th March 2020, into the notification by the Dubai Equine Forensic Unit (EFU) that the prohibited substance Cimetidine had been detected in the post-race urine samples taken from;
Inquiry 1 - MURRAY RIVER (USA), after it raced in, Race 4 “Derrinstown Stud Handicap” over 1950m at Jebel Ali Racecourse on Friday 7th February 2020.
Inquiry 2 - STORYBOARD (USA), after it raced in, Race 3 “Ascana-Takaful Arabian Scandinavian Insurance Co. Handicap” over 1600m at Jebel Ali Racecourse on Friday 7th February 2020.

Inquiry 1, evidence was taken from Mr. Erwan Charpy (Trainer of MURRAY RIVER (USA)). For Inquiry 2, evidence was taken from Mr. Mujeeb Rahman (Trainer of STORYBOARD (USA)). In both Inquiry 1 & 2 evidence was taken from Dr. Kieran Finn (ERA Regulatory Veterinarian) and Dr. Michael Subhahar (Chief Analyst – Dubai Equine Forensic Unit). The following matters were established from both inquiries;
1. On Sunday 16th February 2020, the ERA Stewards were advised of the irregularity to Cimetidine in respect to the post-race urine sample taken from MURRAY RIVER (USA) and STORYBOARD (USA).
2. On Monday 17th February 2020, Mr. E Charpy was notified of the irregularity in the sample taken from MURRAY RIVER (USA) via an official stable visit at his Green Stables. Mr. E Charpy stated that MURRAY RIVER (USA) has never received Cimetidine when in his care nor has he used Cimetidine in his stable for approximately 10 years.
3. During the stable visit, Mr. E Charpy further advised that he wished to exercise his right to have the reserve portion of the sample analysed by another accredited racing laboratory in accordance with ERA Rule 95D(ii).
4. On Tuesday 18th February 2020, Mr. M Rahman was notified of the irregularity in the sample taken from STORYBOARD (USA) via an official stable visit at his ARMS Stables. Mr. M Rahman stated that STORYBOARD (USA) has never received Cimetidine and that he does not stock the substance in his stable.
5. During the stable visit, Mr. M Rahman further advised that he wished to exercise his right to have the reserve portion of the sample analysed by another accredited racing laboratory in accordance with ERA Rule 95D(ii).
6. On Tuesday 18th February 2020, the ERA Stewards conducted an inspection at the Jebel Ali Racecourse, specifically to determine where MURRAY RIVER (USA) and STORYBOARD (USA) were stabled on race-day and to interview Mr. Nicholas Bachalard, the resident Trainer at Jebel Ali Stables. It was established that MURRAY RIVER (USA) and STORYBOARD (USA) had been stabled in the “Barn Boxes” on race-day, which had been utilized by Mr. N Bachalard on non-racing days for his registered horses. Mr. N Bachalard explained that he had been stabling horses in the “Barn Boxes” as he was cleaning the air conditioning units of his regular stables. Further, 7 of the 10 horses stabled in the “Barn Boxes” were actively being treated with Cimetidine and Carafate. Mr. N Bachalard advised that on Thursday 6th February 2020, his horses were removed from the “Barn Boxes” and the staff of Jebel Ali Racecourse cleaned the “Barn Boxes”, including replacing the shavings.
7. On Thursday 5th March 2020, the ERA Stewards received confirmation from LCH the laboratory in France, that the presence of Cimetidine was detected in the “B” urine samples from MURRAY RIVER (USA) and STORYBOARD (USA).
8. Evidence was tendered by Dr. K Finn that Cimetidine is a histamine H2 receptor antagonist that inhibits stomach acid production and when present in a race-day sample is considered to be a prohibited substance under the ERA Rules of Racing. Cimetidine undergoes relatively little metabolism within the mammalian body system and is mostly excreted unchanged through the urine. It is recommended not to administer Cimetidine with other antacids, rather stagger the administration of the antacid for 2 hours. The horses under treatment at the Jebel Ali Stables were simultaneously administered Cimetidine and Carafate, an antacid, via an oral syringe. As such, it was suggested that a large amount of Cimetidine would likely have been excreted unchanged from the horses under treatment in the “Barn Boxes”, contaminating the area.
9. Evidence was tendered by Dr. M Subhahar that both the samples provide by MURRAY RIVER (USA) and STORYBOARD (USA) returned low levels of Cimetidine.

Inquiry 1 - Trainer Mr. E Charpy pled guilty to a charge under the provisions of ERA Rule 95AAA 2, in that he presented and raced MURRAY RIVER (USA) at Jebel Ali Racecourse on Friday 7th of February 2020, when the post-race urine sample taken from that gelding, upon analysis, was found to have had administered to it Cimetidine, a prohibited substance under the ERA Rules.

In relation to the matter of penalty, the ERA Stewards noted the following;
• MURRAY RIVER (USA) had been stabled in the “Barn Boxes” at Jebel Ali Racecourse on Friday 7th of February 2020.
• STORYBOARD (USA), another runner at Jebel Ali Racecourse on Friday 7th February 2020, also returned a positive sample to Cimetidine and had been stabled in the same location.
• Stewards were comfortably satisfied that the “Barn Boxes” were contaminated with Cimetidine.

As such, no penalty was handed out to Mr. E Charpy.

Pursuant to ERA 86(ii), MURRAY RIVER (USA) was disqualified from fourth place in Race 4, “Derrinstown Stud Handicap” over 1950m at Jebel Ali Racecourse on Friday 7th February 2020, and the placings were adjusted to:

In relation to the matter of penalty, the ERA Stewards noted the following;
• STORYBOARD (USA) had been stabled in the “Barn Boxes” at Jebel Ali Racecourse on Friday 7th February 2020.
• MURRAY RIVER (USA), another runner at Jebel Ali Racecourse on Friday 7th February 2020, also returned a positive sample to Cimetidine and had been stabled in the same location.
• Stewards were comfortably satisfied that the “Barn Boxes” were contaminated with Cimetidine.

As such, no penalty was handed out to Mr. M Rahman.

Pursuant to ERA 86(ii), STORYBOARD (USA) was disqualified from 14th place in Race 3, “Ascana-Takaful Arabian Scandinavian Insurance Co. Handicap” over 1600m at Jebel Ali Racecourse on Friday 7th February 2020:

Relevant Rules:
ERA 86(ii) – Where any declared runner has been the subject of an examination under the Rules 8(vi) and or (vii) and has been found to have received a Prohibited Substances, the Horse shall be disqualified from the Race and from other Races as the ERA determines.

ERA Rule 95AAA 2 – Any Trainer or other Person in charge of a Horse, which is presented to Race or performed a Test, or has Raced or performed a Test which is found (upon analysis) to have had administered to it a Prohibited Substance, shall be liable to a Penalty.

ERA Rules 95D(ii) – Upon the detection by an Accredited Racing Laboratory of a Prohibited Substance in the Sample from a Horse, such laboratory shall notify its finding to the Stewards, who shall then notify the Trainer of the Horse of such finding and give him the option to have the reserve portion of the Sample Tested at another ERA-approved Accredited Racing Laboratory. The Trainer will have 3 days to notify the Stewards of such requirement. A refusal by the Trainer to Test the reserve portion of the Sample shall not prevent the Stewards from having the reserve portion of the Sample Tested.
